Auction Rules
A. Bidding
1. Bidders must register for an official bid number and must show appropriate proof of identification. BY REGISTERING, EACH BIDDER AGREES TO ABIDE BY THESE AUCTION RULES.
2. Each bidder must ensure that they are bidding on the right item. Bidders should double check the lot number of the item they want to purchase--many of the items for sale may look similar.
3. When bidding on an item, the bidder must raise his/her bidder number in the air and hold it out until the auctioneer acknowledges the bid. Please keep your bidder number visible to the auctioneer, as this will help speed up the auction. If the auctioneer does not see your bid, please speak up.
4. ALL ITEMS ARE SOLD AS IS, WHERE IS. No item is sold until the auctioneer says "Sold!" ALL SALES ARE FINAL. ALL SALES ARE ENFORCEABLE, COMPLETED TRANSACTIONS ONCE THE HIGHEST BID IS ACCEPTED BY THE AUCTIONEER. Carefully dispose of your bidder number card as registered bidders are responsible for all purchases made with their bidder number.
5. The auctioneer reserves the right to remove any item from the auction before bidding starts on that item or any item that has a reserve price that has not been met.
6. Bidders Choice, various auction lots will be sold as "bidders choice". The highest bidder will have the choice of the lot or lots they want. The high bid is then multiplied by the number of chosen lots (example, high bid is $15 and the bidder wants 3 lots, $15 X 3 = $45. The auctioneer will announce "bidders choice" when defined number of lots will be sold in this fashion.
B. Payment
1. Buyers must pay in full for their purchases within one hour after the auction ends. Cashiers will not be onsite to accept payment after one hour following the close of the auction.
2. Buyers must pay for purchased items with either cash, cashier’s check, certified check, or money order. However, DuPage County residents may pay by personal check up to $500 with appropriate identification showing residency in DuPage County. No company checks will be accepted, except those that are accompanied by a bank guarantee letter. The guarantee letter must be on bank letterhead, show corporation name and address, and be signed by a bank Officer.
3. The record of sale kept by the auctioneer, bookkeeper or Forest Preserve District will be taken as final in the event of a dispute.
C. Removal of Purchased Items
1. Buyers must remove their purchased items from the auction site within one hour following the end of the auction. Buyers are responsible for making all arrangements and paying all costs for removing their items from the action site. Arrangements to leave items on site past the one-hour deadline must be made after the auction with the auctioneer and are subject to the discretion of the auctioneer and the storage fees referred to in paragraph C.5. The Forest Preserve District of DuPage County is not responsible for any items left on District property.
2. Titles for any vehicles, boats or trailers or other equipment left onsite beyond one hour after the end of the auction will be kept by the District until the items are removed by the buyer.
3. Items left onsite beyond one hour after the auction will be available for pickup only during designated District business hours and at the discretion of the District Fleet Services staff.
4. Under no circumstances shall a buyer be allowed to leave a purchased item on- site longer than two business days following the close of the auction without accrual of storage fees, even if permission to leave the item was given by the auctioneer.
5. Purchased items left onsite by the buyer beyond two business days following the close of the auction will be subject to a storage fee of 10% of the auction sale price of that item for each calendar day beyond the allowable two business storage days. All storage fees must be paid before items can be removed from the site.
6. After 10 calendar days of storage fee accrual, title to and ownership of any purchased item left onsite will be forfeited back to the Forest Preserve District as payment for the accrued storage fees. In such case, the buyer is not entitled to any refund.
D. Safety
1. Each bidder is responsible for his/her own safety around the equipment, vehicles and other items to be auctioned. By registering to bid, the bidder voluntarily waives, releases and holds harmless the Forest Preserve District of DuPage County from any and all claims, causes of action and damages for bodily injury or death that the bidder may suffer as a result of, or in any manner connected with, directly or indirectly, the bidder’s participation in the auction. In no event shall the Forest Preserve District of DuPage County be responsible for the safety of a bidder or for accidents or injuries to a bidder involving the vehicles, equipment or other items being sold at the auction. The bidder acknowledges that the waiver and release provided for herein precludes his/her right to recovery of damages in the event they are injured during the course of the auction.
BIDDERS WHO FAIL TO COMPLY WITH THESE AUCTION RULES ARE SUBJECT TO BEING DISQUALIFIED FROM THIS AUCTION AND ANY FUTURE AUCTIONS.
